涉嫌事實
陳建安明知愷他命係毒品危害防制條例第2條第2項第3款規定之第三級毒品，與蘇志紘、林士傑、侯英群基於共同運輸第三級毒品、私運管制物品進口、行使偽造私文書之犯意聯絡，於民國109年9月3日，在英國境內將愷他命夾藏於婚紗照相框背板內寄送來臺。 CHEN CHIEN-AN was fully aware that ketamine is Category 3 narcotics pursuant to Subparagraph 3, Paragraph 2, Article 2 of the Narcotics Hazard Prevention Act. He was also fully aware that transportation and possession of more than 20 grams of pure ketamine are prohibited. Moreover, ketamine is listed in Subparagraph 4, Article A as a controlled import/export substance that shall not be imported without authorization under the "Controlled Articles' Items and Amounts" pursuant to Paragraph 3, Article 2 of the Smuggling Penalty Act promulgated by the Executive Yuan. However, through collective criminal intent, CHEN liaised with Zhi-Hong Su, Shi-Ji Lin, and Ying-Qun Hou for the purpose of joint transportation of a Category 3 narcotic, smuggling controlled substances, and forgery of documents. CHEN CHIEN-AN concealed ketamine (pre-testing total net weight of 2,667.52 grams, post-testing total net weight of 2,664.77 grams, and gross weight by purity of 2,139.62 grams) in the back board of wedding photo frames in the United Kingdom on September 3, 2020. Using the name of "LIN WEN HSIANG" as the recipient, "1F., No. 19, Yunong Road, Banqiao District, New Taipei City" as the receiving address, and mobile phone number "0930742061" as the contact number, the package was sent to Taiwan by CHEN CHIEN-AN from the UK (tracking number: 397990152026, hereinafter referred to as "the package with narcotics") through FedEx Express International B.V. (the Netherlands) (hereinafter referred to as FedEx), which was unaware of the package's content. CHEN CHIEN-AN promised to cancel Zhi-Hong Su's debt of NTD 30,000 as compensation for picking up the package with narcotics. Zhi-Hong Su, in accordance with CHEN CHIEN-AN's instructions, was responsible for contacting FedEx in the name of Wen-Xiang Lin with a mobile phone provided by CHEN CHIEN-AN with the number "0930742061." In return for NTD 60,000, Ying-Qun Hou was instructed by CHEN CHIEN-AN to find a candidate who would personally collect the package for a remuneration of NTD 10,000. Ying-Qun Hou found Shi-Jie Lin and delivered him a work phone with the number "0931125062". After the package arrived in Taiwan on October 22, 2020, with the criminal intent of forging a private document and signature, Zhi-Hong Su sent FedEx the customs declaration document with the forged signature of "Wen-Xiang Lin" on October 23, 2020, for FedEx to go through the import declaration formalities, which further caused damages to Wen-Xiang Lin and FedEx. Shi-Jie Lin arrived at 1F., No. 19, Yunong Rd., Banqiao Dist., New Taipei City on October 28 awaiting the package's arrival. However, FedEx failed to deliver it that day, and Shi-Jie Lin thus followed Zhi-Hong Su's instructions and contacted FedEx to arrange a delivery the next day (29) changing the contact number to the aforementioned work phone. At approximately 11:53 on October 29, 2020, Shi-Jie Lin waited for the FedEx delivery personnel to arrive at the shipping address, while Zhi-Hong Su drove around on his private passenger vehicle with license plate number BGU-0907 monitoring the situation nearby and waiting to collect the package. The delivery process of the package with narcotics was halted by on-site officers of the New Taipei City Field Division, Ministry of Justice Investigation Bureau, who seized the package with narcotics.
